Any data that might be available on the patent royalty rates (e.g., as
a percent of sales, on a $ per unit basis, etc.) awarded by courts
and/or agreed to by litigants in patent infringement cases?
Examples of individual cases and settlement and/or license agreements,
as well as any "macro" reports on royalty rates that are being
observed in the market, would all be helpful.

Hi there,

The results of our search has returned the following:

Before I get going, I just wanted to make clear that this type of
information is very general and tends to vary by industry.

As the resource listed below states, royalty rates have a tendency to
follow with the elasticity of the given product's market:

http://groups.google.ca/groups?q=patent+royalty+rates&hl=en&selm=aFkp3.11118%24J5.126096%40c01read02-admin.service.talkway.com&rnum=1

There is a VAST set of information available in the various discussion
threads listed in the link below:
http://groups.google.ca/groups?q=patent%20royalty%20rates&hl=en&sa=N&tab=wg

Here is a nicely laid out description of what factors affect royalty
rates. This was done by an intellectual property enforcement firm:
http://novelint.com/royaltyrates.html

Though I'm not sure if you'd be interested in this, here is a link to
a consulting group that will consider the product that you are trying
to patent and will provide you with a royalty amount with which to
apply (note that this is an economically based process, so you will
receive information about similar patents that are already in place):
http://www.royaltysource.com/rsrr.html

I'm sure these sources will provide you with much more information
than you will need, but if you have any further questions feel free to
post a clarification :)

Hope this helps!

The groups were something I had forgot to check, and were somewhat
helpful, as was the general link. Answer didn't really adress patent
infringement reasonable royalty awards by courts or settlement/license
agreements. Of course, I know this is a hard area to reasearch - that
was one reason I asked for help (I'm actually a legal research expert
by profession.)Mainly I was just looking for any resources I may not
have known about, and it was an urgent request. So for the quick
response and a little info this was $25 that was pretty well spent, in
my opinion.

There is a publication called TheDailyDeal which occasionally
publishes information on IP deals, patent lisencing, etc. THe Daily
deal is primarily concerned with mergers and acquisitions.
It's publised by American Lawyer media.
Try TheDailyDeal.com- Paper copy is ususally $400 per year, but
frequently comped to executives in various industries. A phone called
might get you some issues.
Payoff is they have real numbers from recent deals.

Inventor's Digest (availble on some newstands & libraries) has this
information occasionally.
