Hello--
I have carefully researched your question and have your answer.
According to information I obtained from the Broward County child
support court division, you must first file your case with the Court
Case Processor. This is usually done through a Child Support Worker.
Make sure you have all the paperwork you need in order to file for
this hearing at the time of delivery to the Court Case Processor. The
Court Case Processor will then review your case and set a date for
court. A hearing date is usually set the day you deliver your case to
the Court Case Processor.
The Court Case Processor will print Motions, Notices of Hearing, and a
Sheriff's Return of Service form. The opposing party in your hearing
must be served with this case. Providing you provide a proper address
for your opposing party, service can be obtained in a matter of days
or a couple weeks.
Typically hearing dates are set for a month or so after you meet with
the Court Case Processor. The date of your court hearing depends on
the number of other hearings needed, the amount of time needed to hear
each case, and scheduling of judges. You can see, there are many
variables.
If you talk with the Broward County Clerk of Courts office, Child
Support Division, and tell them about your need to have the hearing
before the end of the year, they may be able to work with you. Make
sure you have a polite discussion with them, even though this is a
very stressful situation.
There are many situations that may delay the date of your hearing. For
example, the opposing party may file for a delay of the hearing date
for a variety of reasons. Or the judge could have an emergency that
delays the hearing. Or there may be trouble serving the hearing notice
to the opposing party.
