An artist and myself (publisher)entered into an agreement whereas
artist was to deliver 12 songs per year. The contract called for 2
additional contract periods.
The contract had a "suspension clause" whereas upon written notice by
publisher, monies to the artist would be suspended until compliance by
the artist.Written notice of the suspension was given in the form of
"I suspend the E.S.A" written in the memo section of a check. The
check was endorsed and cashed. I performed during two and a half
years(contract periods) but the artist only performed with 15
songs.Question: Since the original contract was signed in Nashville in
1989,what is the law regarding the issue of suspension as it relates
to statue of limitation? I can't find any case law.
