Well, I just tried a little investigation myself, here. I called and nicely explained that they had been calling my son, who plays hockey and lives with a billet family in Montana. (True.....everything except them calling him!)I nicely tried to find out why they were calling.....even gave them my son's name, which I knwew there would be no record of, and then gave them a semi-false billet family name. I could get no information out of them. I asked who they were, and they said, well, we represent a lot of different companies so I don't know exactly what it would be about. I asked if they were some sort of collection agency mistakenly calling him....and they said he needs to call and get it taken care of. At one point, the man did say they were a legal firm that represent many different companies........so, it remains a mystery, I guess. I asked if he could write to them and it was "oh, no, no, no....he needs to call!" |

HI DocMorris, What I am reading is seriously disturbing. After reading all the above, if this were me, I'd drop by my local police station and ask them to direct me to someone who could help me track this down. While I can't point to the law, I do know that it is illegal for a collections company to call you, to harrass you and to not provide identification, so you can contact them or write to them. If the police won't help, call you state's attorney general and ask them for assistance. You will probably get help. And if they're based in California, call my Attorney General's office. Good luck! It might be worth your time to look at this site from the FTC. There is a little thing called the Fair Debt Collection Practices Act and since it appears that this company is an outside collection agency, they would probably fall under this category. A federal law, The Fair Debt Collection Practices Act, prohibits debt
collectors from abusing or harassing you, calling at inconvenient
times, calling repeatedly with the intent to annoy, or using offensive
language.
The Fair Debt Collection Practices Act
FTC (1-877-FTC-HELP)
You have the legal right to demand that a collection company contact
you only by mail, and not by phone.
If you are getting calls at work, have the receptionist screen the
calls and get the person's full name.
Collectors are forbidden from: threatening to garnishee (put a lien
on) your paycheck or calling you early in the morning or after 9:00
p.m. at night. Also they can't tell someone else like your employer
that you owe money in order to embarrass you.
When receiving harassing phone calls, have a tape recorder on hand.
Simply say: "Please wait a moment
I am now recording this call.
Today's date is ____________. Proceed." They will likely hang up.
Write this on a card, place it near your phone, and use it when
needed:
"The Fair Debt Collection Practices Act, a federal law, forbids
harassment, oppression or abuse by a bill collector. What is your full
name, what is the full name and address of your company? I am noting
everything that you say."
Or "Did you know that Section 1692k, provides for penalties of $1,000
for each violation?"
You could write a "Drop-Dead" Letter to the collection company.
{of course, in your case this would be difficult since they won't
identify themeselves}
Something like "Your company has contacted me regarding a debt that
you allege is owing. Please accept this letter as notice that you are
not to contact me further in connection with this matter. Pursuant to
the federal law, Fair Debt Collection Practices Act, you may not
contact me further once I have notified you not to do so." However, if
the debt is large enough, they may proceed with legal action.

Notify your local telephone company of the calls and their harrassing
nature ( they are generally quite responsive), also contact your
state's consumer protection agency and/or the attorney general's
office.
