Right next door to where I live there is an elderly home (I live in
the San Franzisco Bay Area). It seems though that this place is more a
mental institution. There are funny things happening, weird people
walking around(asking for money to buy crack), and strange noises at
night up to the point where it can be dangerous. Asking a nurse
working there whether this is a mental institution, she insisted that
this is clearly an elderly home. The sounds at night, the age of the
patients and a lot of other things show clearly that it is not!!

My question is: What are the requirements for a mental institution?
(do they need special facilities and permissions). Is an Elderly home
alowed to care for people with obvious mental problems? Who is
enforcing or checking mental institutions in California or who do I
have to report this place to. (Is there anything I can do at all?)

“TITLE 22, CALIFORNIA CODE OF REGULATIONS”, governs the requirements
for all Mental Health institutions and facilities in California.

In addition, they must also meet certain criteria as stated in the
“CALIFORNIA WELFARE AND INSTITUTIONS” Code

Both of these sources I have provided for you are fully searchable.
The laws and regulations pertaining to these facilities are obviously
voluminous and will likely take you quite some time to study.

As a means of seeking some relief from circumstances arising from the
facility in question or it’s impact on your community, you may find
that by contacting these agencies you can either start the process of
rectifying perceived problems or obtain more information on how to go
about doing so:

If you were unable to get satisfaction from these agencies or
referrals to other agencies that may be of assistance to you, I’d
recommend you then approach this issue from a criminal/public safety
standpoint. You may call the police whenever you witness or suspect
the following situations (among others) are occurring: Loitering,
panhandling, drunkenness, trespassing, indecent exposure,
prostitution, drug sale/use, disorderly conduct, or other suspicious
or questionable behavior. Additionally, you should notify the
authorities if you suspect that someone is in need of supervision due
to their own inability to care for themselves.

To find out if a particular activity is considered illegal in your
areas, you can search this site for all California laws pertaining to
crime, health and welfare, safety codes and so forth. It, too, is a
fully searchable and comprehensive source. To search for criminal
offenses, for example, you will select PENAL CODE before conducting

If these remedies do you correct the problem, consult your city
officials or send them a formal complaint in writing (I recommend
registered mail, in the event that you are forced to seek a legal
remedy against the city).
