I am having a problem with a purchase I made on Ebay. The item's Ebay
listing is here:

Although the auction states "Will ship to United States only", I
emailed the seller prior to the end of the auction and asked if he
will ship to Europe if I would pay the international shipping fees, he
agreed. I paid with Paypal.

I have not recieved the item yet. I have missed the two month Ebay
fraud protection term and thus I am no longer eligible for it. I
waited this long because packages often take quite a long time to get
from the US to Europe.

I asked the seller to ship the package insured and paid for insured
shipping, of course, I have no way of knowing if the really did so.
When the package did not arrive, I demanded the seller to go to the
post office and fill out an insurance claim, once two weeks ago and
once a week ago. I have got no reply from the seller to these emails.

I wanted to know what should I do in this situation and is there any
way how I still can get my money back? As far as I understand, I am no
longer covered neither under the Buyer protection program of
Squaretrade nor Paypal.

Hello harijs,

It is unfortunate that you missed the 60 day deadline because they
require that they seller have proof that the item was actually
shipped.

Here is what I suggest you do: First… use this form to obtain all
contact information from your seller, and most importantly if a phone
number is shown, phone the person and try to reason with them.

If this fails, write up a lengthy email to ebay and send it to the
seller in question. Tell him that if you receive no response in five
days, that you will be sending the letter to Ebay and Paypal directly.
Also mention that you are serious about resolving this outstanding
issue and that you are seriously considering finding a legal
representative in Houston Texas.

In the letter be firm and honest about everything that has happened so
far, and provide as much documentation as you have. Include ALL
communication to and from this individual and mention that you have
the headers to prove the times the emails were sent (if you do).
Request that an immediate reply be sent including a tracking number
for the shipment and proof that the item was shipped (IE: receipt).
Also request that a copy of the completed insurance form be faxed to
you. If you clearly asked for insurance, there is no way this person
should be able to get away with this. Insurance would usually come
with tracking depending on which company was used. (Note though that
insurance claims can take WEEKS to come back and that the person might
very well be working on this, the letter should help you figure this
out.)

After five days if you are not making headway contact Ebay directly
and tell them about this situation. In your letter to Ebay give them a
quick summary of what happened at the beginning of the header.

I was using the online chat with an Ebay representative and he said
that Safeharbor will still work with you to get this resolved even
though you are no longer covered for the insurance. Click on MEMBER
PROBLEMS, SELLING OFFENSES, and then click on I sent money but haven’t
received the item. Click Next and then click Contact Support at the
bottom.

If this does not seem to be getting you a reply or you are not
satisfied with what they are doing, you might consider contacting a
consumer group to put pressure on Ebay or emailing various media
attempting to get media exposure. This might pressure Ebay into
attempting to solve the problem if they decide the bad publicity is
not worth it.

They recommend that you post a complaint with http://www.fraud.org/

I am not sure how Paypal works in the UK, but if the money was
deducted from your bank account or credit card, then there is a good
chance you can get the charges reversed. Credit Card companies are
fiercely protective of their customers and you will have no problem
getting a charge back done. I have personally had to do one of these
and was surprised at how fast it went through after I showed them the
proof. If the money was deducted from your bank account, then you
might be able to get your bank to work with Paypal for you.

Now if the money was sitting in your Paypal account and you get no
headway from this person or from ebay, send a copy of all your
correspondence with Ebay and this individual and ask them for special
consideration. Paypal is also a company that is protective of its
customers, but I am not sure how well this applies to international
users.

Finally you should seriously consider filing legal action against this
individual, although it might cost more if you do not win. If you have
a strong case you should have no problem getting awarded your money
back plus any legal fees. You would probably have to find legal
council in Houston Texas will to work with you (without you actually
going to Texas).

Next, try contacting Ebay UK and ask them to resolve this for you. It
might be possible that they will compensate you for your troubles. You

One final thing I can think of if all this fails is to make a website
with your story and telling people exactly what happened and who it
happened with. The person might be pressured into resolving the issue
if a story on the internet with all their information is published.
You could post a link to this page in the negative Ebay feedback you
post (if that is not against Ebay regulations).
There are websites out there like this and the media regularly picks
up on these and this can hurt Ebay the company. Here are just a few:

I wish you the absolute best and hope that this answer will help you
resolve this problem. I too have had the occasional problem with
buying on Ebay, but have been able to resolve all cases. One
suggestion for next time is not only to ask for insurance, but to also
request a tracking number. With a tracking number you can know after
30 days if the item was shipped or not by contacting the shipping
company.
