This question concerns UK Tenant / mortgage law

Can you tell me what the procedure is for evicting housebuyers that do
not pay mortgage payments on time?

How long is it between judgement and the time I can evict the
defaulting house owner ?

Are these *tenants* who pay rent, or *owners* who don't pay their mortgage?
If tenants, what is the type of tenancy agreement?
Where in the UK are you, as legal process differs between Scotland and England?

In my experience, the most effective measure is to send in the heavies.

Hi Owain,

They are owners who don't pay their mortgage.

I have a property which I own - I want to pass the Equitable title to
someone who will pay me monthly payments (and make profit in this
way)ie I will act as the mortgage lender

I live in England

Thanks

Basically, you will need to go to court and get a reposession order on
the house. You must be carefull not to harass a debtor in any way,
as that is a criminal offence. Given the presumed financial values
involved, you really need to see a solicitor experienced in this
field.

If the tenants fall into rent arrears of two months/eight weeks, serve
a section 8 notice(*) and consider bringing proceedings for
possession. If the tenant pays no further rent, arrears of at least
four months will have accrued by the time a possession order is
obtained.

(*) The notice can be filled in here:

Thanks stec00, this is good stuff

Just to clarify - you are talking about my right as a "bank", to evict
someone who has taken a mortgage with me - right ?
