Question ID: 188903
what are the laws against cutting tree hangings on an ajoining
property. I asked this befor and lost the paperwork. Our neighbor cut
our trees straight up without asking our permission. These trees tower
as high as our house (2 story). This was not done in a neat fashion.
Each year we trim any overhanging branches from our fence. (6'high
fence)The trees are brutally cut, even parts the grow straight up and
do not hang on her side. I know who ever researched for me befor did a
fantastic job on finding the laws from the Surpreme Court. I live in
Struthers, Ohio. Please help.

Hi again. There is really nothing I can add to the previous answer.
I wish there were. If the neighbor actually came on to your property
to do the cutting, you may have some kind of a case. But, beyond
that, unless Struthers has become a "tree city" since your last
question, everything remains the same.

Wish I could hold out more hope for you.

I couldn't help but notice that you mentioned that "...even parts the
grow straight up and do not hang on her side..."

That implies to me that your neighbor must have been on your property
in order to cut these limbs. And from digsalot's previous answer:

"...* you need permission to enter the tree-owner's property (unless
the tree poses "imminent and grave harm" to you or your property);
* you may not destroy the tree by trimming it..."

It doesn't sound like you would have given your neighbor permission to
enter your property, so you probably have something to go on there.

I had a tree trimming experience myself not too long ago. Fortunately,
our neighbors were very gracious. Good luck...
