Many states have home medical equipment fee schedules for workers
compensation. How do we find which states and where we can get a copy
of their fee schedule?

Would a response containing the state's worker's compensation
schedules in full be sufficient? Or do you only want information on
home medical equipment schedules?

Not all states have home medical equipment (also referred to as HME or
DME) fee schedules. If we can get just the information for those
states with HME fee schedules, an "in full" response would suffice.

Hi Kazy,

I've sifted and sought for most of the day in an effort to answer for
you, and have discovered that many states do not put this information
online - some only include a brief overview and require that you
request the fee schedule in writing. Still others, such as
California, *charge* for the information ($38 for CA!)

Perhaps this clickable map, with links to the state divisions of
Worker's Compensation, will be of some use to you, or another
Researcher:

I'm sorry I couldn't be of more help.

Hi Kazy-ga,

As you probably know, all states are required to use the DMEPOS Fee
Schedules to receive Medicare reimbursement. The schedules are updated
on a quarterly basis.

http://cms.hhs.gov/providers/pufdownload/default.asp#dme

allows download of the complete 2003 Medicare DMEPOS Fee Schedules for
all regions.

Some states adjust these calculations to set their own figures for fee
schedules for workers compensation. According to Wise enterprises
there are 33 states with adjusted schedules: Alabama, Arkansas,
Arizona, California, Colorado, Florida, Georgia, Hawaii, Kansas,
Kentucky, Louisiana, Maine, Massachusetts, Michigan, Minnesota,
Montana, Nebraska, Nevada, New Mexico, North Dakota, Ohio, Oklahoma,
Oregon, Pennsylvania, Rhode Island, South Carolina, South Dakota,
Texas, Utah, Vermont, Washington, West Virginia, and Wyoming.

The link mentioned in the comments will lead you to individual contact
for each of these states so I won’t list them here. Many do ask for
fees or require that you write for the information. Examples are:

Alabama:
http://www.dir.state.al.us/docs/forms/wc_order_form.pdf
a printed copy of the fees is $50. On diskette the charge is $37. Both
are available in a combined package for $59.

Arkansas:
Arkansas Workers' Compensation Commission has developed a Medical Fee
Schedule which establishes schedules of maximum fees by a health
facility or health care provider for treatment, attendance, service,
device, apparatus, and medicine. The Medical Fee Schedule, maintained
by the Medical Cost Containment Division, is reviewed and updated on
an annual basis.
For information contact:

Arkansas Workers' Compensation Commission
ATTN: Medical Cost Containment Division
P.O. BOX 950
Little Rock, AR 72203-0950

There are services that will give you access to many of these for a
fee:

http://www.rmlibrary.com/cgi-bin/suid/~rmlib/sites2.cgi?worke:worfeesc
is a subscriptions site
(Standard Subscription Annual $300 1 Month $35
Educational Discount Rate Annual $180 1 Month $24)
with many of the schedules online, although they note that some of the
State fee schedules have to be ordered at an additional cost. They do
not list all 33 that have their own schedules.
Arkansas, California Colorado, Florida, Hawaii, Kansas Louisiana,
Massachusetts, Maryland (+fees), Maine, Michigan, Mississippi,
Montana, North Carolina, North Dakota, Nebraska (+fees), New Mexico
(+fees not accessible online), Nevada (updates only), New York
(hospitals only – DME not accessible), Ohio (access to database
information accessible by code), Oregon (rules only), Pennsylvania
(partial information), Rhode Island (+fees), South Dakota, Texas (text
of rules only – no fee schedules), Utah (+fees), Vermont (text of
rules only – no fee schedules), Washington (department’s rules,
payment policies and CPT & HCPCS fee schedules), Wisconsin (Fees by
CPT Code for hospital radiology WC charges), West Virginia, Wyoming.

Another subscription data base that seems to have better information
is Wise Enterprises (WisEnt)
http://www.wisent.com/c_wrk_wcf01.htm
They list the Workers' Compensation Fee Schedules for:
Alabama, Arkansas, Arizona, California, Colorado, Florida, Georgia,
Hawaii, Kansas, Kentucky, Louisiana, Maine, Massachusetts, Michigan,
Minnesota, Montana, Nebraska, Nevada, New Mexico, North Dakota, Ohio,
Oklahoma, Oregon, Pennsylvania, Rhode Island, South Carolina, South
Dakota, Texas, Utah, Vermont, Washington, West Virginia, Wyoming

According to this database service, the following states allow payment
of Workers' Compensation claims at usual and customary rates:
Delaware, District of Columbia, Idaho, Illinois, Indiana, Iowa,
Missouri, New Hampshire, New Jersey, Tennessee, Virginia, Wisconsin.

This doesn’t account for:
*Alaska http://www.labor.state.ak.us/wc/wc.htm
A search of the legislative database at this site shows no state
specific schedules for reimbursement:
http://old-www.legis.state.ak.us/cgi-bin/folioisa.dll/aac/query=[group+!27t!2E+8!2C+p!2E+3!27!3A]/doc/{@1}/hits_only?
*Connecticut http://wcc.state.ct.us/siteindx.htm
There is no mention of home medical equipment fee schedules for
workers’ compensation. They do specify that the 2002 Official
Connecticut Practitioner Fee Schedule is “available in print for
$85.00 and in ASCII format (print copy included) for $305.00. To
order, please contact Ingenix at 1-800-859-2447.” (See the link for
Maryland’s publication below)
*Florida http://www.flsenate.gov/Statutes/index.cfm?App_mode=Display_Statute&URL=Ch0440/titl0440.htm&StatuteYear=2002&Title=->2002->Chapter%20440
The worker’s comp code does not mention any state schedule or
adjustment to the Federal figures.
*Maryland http://www.wcc.state.md.us/General_Information/Medical_Providers.html
Their guide has not been updated since 1995. They do not state whether
the home medical equipment fee schedules for workers’ compensation
figures are specific to the state. The printed schedule can be ordered
online at:
http://www.ingenixonline.com/modules/catalog/catalog_product.asp?ProductID=3337&CategoryID=
*Mississippi http://www.mwcc.state.ms.us/INFO/keycontacts.html#ncci
Medical Cost Containment (Fee Schedule Questions): 601-987-4280.
E-mail: sjones@mwcc.state.ms.us.
Medical Fee Schedule (Ordering): 800-765-6023
*New York. http://www.wcb.state.ny.us/content/main/hcpp/medfee.htm
There is no home medical equipment fee schedule listed, however the
RMLibrary site did list this state as having as DME schedule.

If you need additional clarification, please post and I will follow up
with the information.

Hope this is helpful.
