I have checked individual state laws in the United States, and have
found that there are no laws specifically banning sexual acts while
using a herbst appliance.  However, the act of oral sex amongst
same-sex or even opposite-sex partners is banned by the sodomy laws of
various states as follows:

Oral sex banned between same-sex couples in:
  Kansas
  Missouri
  Oklahoma
  Texas

Oral sex banned between same-sex and opposite-sex couples in:
  Alabama
  Florida
  Idaho
  Louisiana
  Mississippi
  North Carolina
  Puerto Rico
  South Carolina
  Utah
  Virginia

In addition, laws against oral sex are on the books in Michigan,
Massachusetts, and Missouri, but their legal status is currently in
question.  For more details on the penalities imposed by these sodomy

So, the answer to your question is that a person CAN give oral sex to
a male with a herbst appliance installed, provided the act of oral sex
itself is allowed under the state's sodomy laws.

Hello ctb,

Given that orthodontists caution patients with Herbst Appliances not
to jostle it in any manner, push it with the tongue or put anything
hard in their mouths, it would seem unwise to accept a gift of oral
pleasure from a young lady wearing said appliance.

She could damage her jaw and hinder the therapy the appliance is meant
to provide, and the gentleman could possibly end up with an impromptu
bobbitectomy.

Not recommended, unless one has a chain-mail prophylactic close to
hand.

In my opinion, hailstorm-ga answered whether a person MAY (is allowed
to) do this, rather than whether the person CAN (is able to) do this. 
Missy-ga's comment addresses whether the person can, or should, do
this.

Well, that's perhaps a subject of ambiguity.  But I would also think
that Missy's assumption that the person in question is a female is not
valid, given that a herbst appliance can be worn be someone of any
gender.

Oral sex is also not necessarily a deep throat experience.  Some
gentle licking as a part of foreplay shouldn't be dangerous, so long
as all parties involved know when to say when.

Hi Stormy,

I don't think the gender of the orthodontically impaired individual is
relevant.

That I answered from a het perspective hardly invalidates my opinion -
namely that one ought not put one's valuable bits in the vicinity of
heavy orthodontia, lest both the bits and the orthodontia sustain
damage.

Again I show my stupidity as I dont know what a herbst device is even
though someone only 10 minutes ago answered my current $10 question
with a suggestion that a herbst device would have been approprite.

Thanks for that Missy, and I have not been hiding but you must have
missed all my recent questions I suppose. By the way did you get a
copy of the front page of the cultural section of one of Australia's
main newspapers which featured the  GA site but also words of wisdom
from you particularly( it was you was it not??)  and also including
your Researchers party of July 4 . I am wondering how many Aussie
researchers turn up at Toledo?? or wherver party will be. Robert
Skelton said in article he would attend so thats one at least.

Hee!  Yes John, that was me.  I have a printed copy of the online
version, which my children promptly took to school to show their
teachers.

I guess I *did* miss your recent questions!  I've been a bit busy
trying to get even with my old webhost.  Preoccupation is dangerous!

Most websites I have looked at warn about not opening your mouth too
wide, or pulling at the herbst appliance.  I would say it is possible
as long as you adjust your technique to accomodate these restrictions.
