Is there any way for a person with 3 US children (two over 21 & one
under 18) to stop their deportation after they have already been
denied acceptance to the US over 15 years ago based on a dismissed
felony, but has another offense in the past ten years?
If not, is there anyway to get an immigration judge to rehear the case
once the person returns to their homeland. If possible, what are the
options / actions to be taken?

Your question is confusing the way it is written. I'm going to try to
clarify what you mean so that I or any other researcher will have a
better chance of giving you the answer that you are looking for.

This is the way I understand your question --  (For clarity, let's
call your subject "Bob")

1 -- Bob was denied acceptance to the US over 15 years ago? 
2 -- Bob has three children in the US 
3 -- Bob has recently had a felony charge dismissed  (where?)
4 -- Bob had some other offense in the past 10 years
5 -- Bob has been living in the US ?  (How long and under what
status?)
6 -- Bob is being (or has been) deported from the US? 

If you could clear up our confusion, it would be of great help.

Hi K

I am sorry about the confusion... I did not know how to state it
initially.  Ok here goes.


·	Bob Has been living in the US illegally for 16 years
·	Bob applied for citizenship 15 years ago and was denied because of a
felony charge that was pending at the time in the US.
·	That charge was dismissed a year later
·	Bob never told the INS so a deportation order was put out on this
charge in 1986

·	Bob then had a misdemeanor and a low class felony charge in 1996 in
which he served and completed probation for
·	Bob went to the INS to clear the charges but the INS initial
deportation status from the 1st case has bob about to be deported.
·	Bob children are all US citizens
