Yesterday morning I was looking for the new Annie Lennox CD at the new iTunes Online Music Store and found it, much to my delight, priced at $1.98. In the album section (where only albums are listed and individual songs are NOT listed) there was the picture of the CD, a price listing of $1.98 and a "buy album" button. I clicked the "buy album" button and completed the purchase but instead of the whole album downloading, only two songs downloaded. I e-mailed them, describing my problem and they responded by saying that they were aware of the problem and were attempting to fix it. The price remained listed at $1.98 from early morning until late last night. Today they have informed me that that price was a mistake and that I would have to pay $9.99 if i wanted the entire CD. Is this legal? |

As a general comment, you have a good basis for a complaint. In the past websites have displayed goods at the wrong price, and then increased it before shipping the product. Here, you have gone through the whole process, order, acceptance, delivery - and been given the wrong product. I don't know where you are based, or where they are based, and chances are wouldn't know the law of either. But... good customer service is important. Write them a letter saying how disappointed you were. iTunes will be keen to get people on board paying to download music (not too popular!), so will hopefully consider giving you the album to download anyway. Don't phrase your letter like "...and I DEMAND that you give me the album...", rather be forthright but sensible, perhaps saying something like "...I am a new user to the iTunes service, so I was very disappointed etc etc etc... I am not sure if I will be using the service in the future...". If you're still not happy then perhaps you could look at other (more legally based!) methods. |

Hi, It's called bait and switch, and it's considered illegal. There have been cases where clients have won cases against companies that did this (Kodak http://news.bbc.co.uk/2/hi/science/nature/1795624.stm needed a lot of convincing though) but also cases where the company didn't back down and no one bothered to file a lawsuit because it just wasn't worth it (Bestbuy.com http://hypothermia.gamershardware.com/articles/bestbuy_gf4deal.html ).
