"For taxation purposes, an individual is either resident or
non-resident, and nationality is not a factor in determining tax
status. An individual is considered resident in Luxembourg if he
maintains a residence there with the intention of remaining on other
than a temporary basis. A stay of more than 6 months amounts to
residence. In legal terms, an individual is resident if either his tax
domicile (domicile fiscale or Wohnsitz) or his usual abode (lieu de
sejour habituel or gewohnlicher Aufenhalt) is in Luxembourg." (Source:

This includes, among other sources of income, taxation on some sorts
of pensions (ibid). Pensions paid under Luxembourg social security
will be taxable in the Grand-Duchy. (See: Sami Douénias and Anabela

However, to every rule there's an exception. EU officials, including
MEPs, are taxed in a "community tax" that is deducted from their
salaries. Former MEPs pensions are subjected to tax "payable to the

community taxation (instead of a national taxation) on their pensions.

Dear Patsy, 

Even if they live in Luxembourg, the answer doesn't change. Retired
MEPs are not taxed on their pensions, because they are already taxed
in a community tax. This could of course be disputed, but the fact
remains that this is the current reality.

This is not correct.  Serving MEPs are paid their salaries by their
national governments and are taxed in their home country.
Retired MEPs however are paid their pensions by a Luxembourg A.S.B.L.
from a fund composed partly by contributions from MEPs but mainly by a
contribution from the European Parliament out of its budget as a
Community Institution.  I think it is this factor which leads to
Luxembourg pensioners not being taxed on their pensions.  Do you agree
and if so could you obtain confirmation from the Luxembourg Authority?
I feel I must owe you an extra fee!
