What are the legal implications of creating a CD from a vinyl album? Assuming the copyright is still valid, are you required to destroy the vinyl album to sell the CD? Is even this enough to permit sale of the CD? | |

Here are a few items that may be of interest to you: "Because copyright allows the copyright owner to determine how the copyrighted work can be distributed, you can't legally give a copy even in a different medium to someone else( you have no distribution rights )." http://groups.google.com/groups?selm=Pine.LNX.4.21.0003272310400.251-100000%40krw.penguinpowered.com&oe=UTF-8&output=gplain "Making a copy in a different medium without appropriate authorization would be a violation of the copyright owners rights, unless the activity is excluded under other provisions of copyright law. The making of one copy of a work in a different medium may not be a copyright violation, but what you do or intend to do with that copy is important." http://its.noctrl.edu/tech_ethics/dmca_faq_faculty_staff.shtml#7 "...where you own the original LP or recording you are allowed to make a copy onto a different medium e.g. CD/cassette tape where that recording is for your own use. It would not be legal to sell or give that copy to anyone else for their use." http://www.vinylreplica.com/general.html#what |
