HI, I run my own S/W company and I am in Bangalore. Your question is interesting. Ideally it depends on what kind of business plan you have in mind. 1) If you are looking for having a set of programmers in India and paying them directly, you can always make an arrangement via some companies or even the bank shall assist you. The process shall be cumbersome though. 2) You can start your own company with an Indian partner with your Indian partner holding equity. The process of setting up a company then would be relatively easy. You will need to register with RoC (registrat of companies, Act 1956) and if you hire a CA/Accounting firm, they shall handle all your legal issues relevant to setup. 3) It will also depend on where you want to setup you company in India. The laws would vary a little from state to state (labor laws mainly)....taxation law shud remain the same. If you need more information, you can always contact me.
