I would like information on any complaints or actions (this includes
legal actions) taken AGAINST the Ohio SPCA. I am specifically looking
for a pattern of negligence, improper procedures, or unwarranted or
heavily biased accusations made by the Ohio SPCA which harmed the
accused; as well as any recourse the accused took. |

So far as I can tell, there is no organization named the Ohio SPCA or
the Ohio Society for Prevention of Cruelty to Animals. Do you have a
specific Ohio organization in mind?

I believe each county in Ohio has an SPCA... I am most interested in
the Clermont County SPCA in Ohio, but any information regarding any
ASPCA in the state of Ohio (or even the U.S. if it comes down to it)
would be helpful.

Hello grazina5-ga:
I researched your question quite thoroughly and came up with only one
complaint against an Ohio SPCA chapter: that was a 1999 complaint by a
county auditor alleging that county's SPCA was co-mingling its funds improperly.
However, after more research, I learned that the state auditor refused
to pursue the matter and that was the end of it.
Would that case be of interest to you? Aside from that matter,
everything else I found re: Ohio chapters of the SPCA was really most
laudatory.

nancylynn --
I appreciate your research thus far, but I must admit that
"co-mingling of funds" is not what I am looking for. Of my own
research, I have found it difficult to find much information about the
ASPCA, in Clermont County Ohio or even elsewhere in the United States.
Mission statements and goals, sure... but actual evidence of conduct,
either positive or negative, has been difficult to come by.
Occasionally I can come across a news story regarding the disruption
of a dog-fighting ring, etc., but very little else. With an
organization as large as the ASPCA I am surprised that there is so
little out there.
If I can offer any further clarification on my question, I suppose I
would have to say I am looking for responses from those individuals
that the ASPCA (ideally the Clermont County, Ohio ASPCA, but the ASPCA
at large would fine) has targeted for "animal cruelty" (or similar
charge). What is the aftermath after being charged? What resources,
if any, are at the accused disposal? And what actions have ever been
taken?
I hope there is a way to come up with these answers...
Yours Truly,

Hello grazina5-ga:
You said in your clarification:

This is a somewhat different question than the question you posted
regarding SPCAs in Ohio. Since this question will expire in a few
hours (and it looks like it's going expire as "unanswered"), I
respectfully suggest that you post a new question asking about what
resources are available to someone accused of animal cruelty, and what
actions defendants have taken in challenging charges made by the SPCA.
Because this is a more complicated matter, you may want to consider
raising your fee. Since I, and several other colleagues, have failed
to find any such cases in Ohio, I think this search may well have to
be expanded to a national level.
I hope that one of my colleagues will be able to help you.

Are you looking for examples like this?
http://www.swlearning.com/blaw/cases/criminal/0900_criminal_01.html
(though it the above case, the ASPCA was found to be within their rights.)
