Question ID: 296166
On Dec 29/03 I ordered 2 bottles of Hermes/Caleche @ 35.00 ea. And one
gift set of Escada @42.00.[total] 112.00
When the order arrived I did recieve the set of Estrada, but instead
of the Hermes, was sent two bottles of Charlie perfume, that I could
buy at any drug store for 10.00 a bottle [tops]
This company does not respond to my emails. and I went back and read
the fine print about returns. They charge a 30% "restocking" fee, Plus
I do not trust them at this point, to help me. Is there any help out
there for me? This was to be a gift for my daughter and grandchildren,
and I live on a limited income and cannot afford to lose this much
money. And I cannot give them Charlie Perfume.... The company is
American Fragrance from New York Order #120130.. I paid with a debit
card Thank you..

Is this the company?
http://www.americanafragrance.com/index.php?file=customer

If so, there is a customer service phone number on the above page,
which might prove more successful that email contact.

Customer Service: 212-683-8029

Also, the say:
"There will be a 30% restocking fee on all opened or used items."

If you had to open it before discovering that the wrong product was
supplied, then surely the 30% fee would not apply in your case.

Keep in mind that the worst case scenario was never receiving
anything. That they partially supplied your order indicates perhaps
just a combination of mix-up and poor customer service, rather than a
rip-off.

Oops.

When I suggested that you cancel your question, I had forgotten that
you've received some very useful advice from Researchers. If you would
like to compensate a Researcher who has helped you, instead of
canceling the question you can ask a Researcher to post an official
answer. You can choose which Researcher you'd like to do this. The
Researcher will receive his or her share of the $5.00 fee, and you
may, if you wish, add a tip when you rate the answer.

Sounds like a tough situation. Do you know if your bank offers fraud
protection for items purchased over the internet? Many do, so you
might want to call them and find out.

First, save all emails and recipts or invoices, both by printing them
out, and keeping them on your hard drive.

Make a copy of the sale site both by printing it out and by copying it
to your hard drive. (To do the latter, right click on the site and
select ?Save As.?)

If, after a week, you still can't get a response from the company:

File mail fraud charges with the US Postal Service if you used a USPS
money order, their electronic payment method, or otherwise sent your
payment via the USPS. The proper form is #8165, available by dropping
by your local post office, by calling 1-800-ask-USPS, or by printing
it out yourself using this address:
http://new.usps.com/cgi-bin/uspsbv/scripts/category.jsp?A=B&B=Forms&C=-10189&U=X&U1=B&U2=H

If mail fraud does not apply, then wire fraud may
(http://www.lectlaw.com/def2/w017.htm may. OR contact the business
where you bought your money order
