I'm an independent musician and I want to name my next CD "EVEL". I
need to know if I would be violating any rights by calling the CD
"EVEL". The CD will be sold at my web site, amazon.com and I'm going
to try to get the CD into retail stores. I know there is a whine
company called Evel, so I'm not sure if I can use the name or not.

Hello cgv~

The U.S. Patent & Trademark Office shows claims for the term "evel,"
including the wine, which you mentioned. Here is a link to the latter:

You may also go to this page:
http://tess2.uspto.gov/bin/gate.exe?f=searchstr&state=m0un07.1.1

and type the word evel into the Search Term field and click "Submit Query."


Wolvies is correct that titles cannot be copyrighted, only trademarked.

I was under the impression that titles were not copyrighted and could
not be... Ofcourse, it may depend on what 'EVEL' means and whether it
is a word coined particuarly by anyone for something in particular.
Even so, you may well be able to use it
