Process of requesting an emancipation of a 16 year old child in New
York, the specific state requirements that are needed, the full &
detailed procedure of doing so (meaning which forms to get or where to

Background:
The child is a 16 year old white US-born male in New York City, who is
currently under watch of ACS (Administration for Child Services) and
is placed under custody of a foster family/parent because of a
prolonged neglect and abuse from the birth parents. The ACS currently
does not offer any assistance in that matter, totally disqualifying
the child?s rights and completely ignoring the requests (how wrong of
them to do so.) The foster parents will agree to grant permission, as
long as the requirements are met. The birth parents will not
participate at all and altogether wish the worst for the child. The 16
year old hopes to be emancipated from his parents to escape all the
abuse, and wishes to inquire whether he qualifies for the New York
State emancipation procedure.
Details:
The information I need is barely outlined in the following few notes,

supporter (non-binded by marriage) who will shelter the child (provide
the housing), will that make any difference? Is the child required to
attend school, must he receive a diploma by certain age, attend GED
classes or none at all?
- What is the filing procedure? Step by step if possible, please. I
would very much appreciate it if one provides a very thorough guide on
what documents and papers should be obtained, who?s permission and in
what format should be gathered, where the application form or office
is, and details like that.
- SPECIFIC: The child?s birth parents do not wish to sign for the
child?s emancipation, but pose a very serious physical, mental and
emotional threat to the youngster. If the child is currently under the
custody of a foster parent (placed there by ACS) can the emancipation
be signed by the foster parent? Can a judge accept a certain case
details of which will convince him/her to accept the emancipation,
what are the details of those?
