Question ID: 342475
MY WIFE STARTED A WOMEN'S FITNESS FACILITY ABOUT 3 YEARS AGO
(SUBLETTED SPACE ON THE MEZZANINE LEVEL OF A GYMNASTICS CLUB WHICH
OUR DAUGHTER HAS BEEN TRAINING IN TRMPOLINE AND TUMBLING FOR SEVERAL
YEARS}

HERRE IS THE ISSUE:

THE BUILDING (~100,000 SQ FT BUILDING WITH SOME ENVIORNMENTAL CONCERNS
IN THAT THE LAND WAS LOCATED WITHIN THE BOUNDARIES OF AN OIL REFINERY
MANY YEARS AGO) HAS APPARENTLY BEEN PURCHASED BY ONE OF THE TENENTS
(AND BECAUSE OF THE REFINERY ISSUE I BELIEVE IT WAS PURCHASED FOR A
NOMINAL AMOUNT)AND HAS BEEN DONATED TO THE LOCAL FOOD BANK IN EXCHANGE
FOR A SUBSTANTIAL TAX RECEIPT AND A
PROVISION THAT THE COMPANY RETAINS ITS PORTION OF THE BUILDING( ~1/4
OF THE BUILDING) RENT FREE. (IT APPEARS THAT THE CITY IS ON THE VERGE
OF WAIVING THE PROPERTY TAXES ON THE PROPERY AS THE FOOD BANK IS
SLATED TO BECOME THE OWNER.

HERE IS MY QUESTION:

AS THE OWNER OF A PRIVATE BUSINESS DO WE (DOES SHE):

1--ACCEPT THAT THE OTHER TENENT WAS ASTUTE ENOUGH TO REALIZE THE
OPPORTUNITY AND AS SUCH ABANDON THE LEASEHOLDS , ETC AND JUST MOVE ON

2--QUESTION FOOD BANK AND CITY OFFICALS AS THE WHAT THE ARRANGEMENT
REALLY IS --THIS WOULD NOT BE AN ISSUE EXCEPT THAT IT SEEMS THE FOOD
BANK IS ANNOUNCING ITS "SUCCESS" AND SEEMS TO BE PROUD OF ITS ABILITY
TO "GROW ITS BUSINESS"

--ABOVE IS MAKING A LONG STORY SHORT BUT WITH ONLY HEARING OUR SIDE, ANY THOUGHTS???

A few questions:
1. In what U.S. state or other country is the property located?
2. Is your sublet from the tenant that now owns the building or from
the other tenant?
3. Do you have a written sublease?
4. Did the tenant that sublet to you have a lease that allowed the
sublet and if applicable, did the former owner consent to the sublet
(in other words, can the new owner of the building object to your
being there)?

Thanks
