Hi,
If I want to register a brand name (company name) and logo in the US
(as well as CANADA and the EU) how do I go about it. Basically, I
would like to trademark it like for example you can't copy the Coca
Cola name anywhere in the world or its logo (legally of course).
Basically just registering as a trade name or both the name and the
logo. The logo is more important. Thanks.

Hi smitf7,

What you are talking about is registering a trademark and you'll find
everything you need to know at the United States Patent and Trademark
Office - I've picked out a few keys points for you, but the website is
much more comprehensive and easy to navigate.

Basic Facts About Trademarks:
What is a trademark or service mark?
* A trademark is a word, phrase, symbol or design, or a combination of
words, phrases, symbols or designs, that identifies and distinguishes
the source of the goods of one party from those of others.
* A service mark is the same as a trademark, except that it identifies
and distinguishes the source of a service rather than a product.
Throughout this booklet, the terms "trademark" and "mark" refer to
both trademarks and service marks.

Is there a form for filing my application?
Yes. Using the Trademark Electronic Application System (TEAS)
available at http://www.uspto.gov/teas/index.html , you can file your
application directly over the Internet.

What must the application include?
NAME OF THE APPLICANT
NAME AND ADDRESS FOR CORRESPONDENCE
DEPICTION OF THE MARK ("THE DRAWING")
GOODS AND/OR SERVICES
APPLICATION FILING FEE
BASIS FOR FILING
SPECIMEN
SIGNATURE
http://www.uspto.gov/web/offices/tac/doc/basic/

Where Do I Start?
"There are several resources within the USPTO website. These include
information as well as online capabilities for every stage of the
registration process. In fact, you can conduct most of your trademark
business with the USPTO online. Therefore, you should familiarize
yourself with our site before you begin the trademark application
process."

Types of Intellectual Property
"The first step is to determine what type of intellectual property
protection you need."

Basic Information and Rules of the Road
"Ok, so now you have determined that a trademark is what you need."

Searching Trademarks
"The next step is to search our database, before filing your
application, to determine whether anyone is already claiming trademark
rights in a particular mark."

Filing a Trademark Application
"You may file your trademark application online using TEAS - the
Trademark Electronic Application System."

I hope I've helped you get started with registering your trademark. If
you have any questions, please post a clarification request before
closing/rating my answer and I'll be happy to reply.

Thank you,
hummer
