Can a person be prosecuted for being financially unable to fulfill an agreement to provide FULL restitution which was one of the terms of a ten year sentence of probation? All other provisions have been satisfied. The "no contest" offense was for Felony Theft. The judge (ten years ago) allowed this defendant to "pay what you can", which I have made timely payments of various amounts an amount a fraction of the original agreement, resulting in a large balance still due. I was diagnosed with Parkinson's approximately nine years ago and receive a Social Security payment of $600 monthly which is my only source of income. I will be appearing before the court (Harris County Court 262) at the end of this month with a court appointed attorney. |
