What does Fenderson v. West, 12 Vet. App 119 (1999), U.S. Court of
Applleals for Veterans Claims,  say? I recently had my appeal to the
Board of Veterans' Appleals remanded back to the Regional Office of VA
to consder this ruling.

Dear hoss1,

Since it is not easy to say with regard to what circumstances of your
particular case your appeal was remanded back on grounds of Fenderson
v. West, 12 Vet. App 119 (1999), I decided that the case record itself
would be the most helpful information I could provide you. With the
full text (which is not very long, by the way), you can easily
determine the parallels between your case and Fenderson v. West
without having to reveal details here in public.

It took time, but I finally located the text of that case. Although
the record is available for dowload on the U.S. Court of Appeals for
Veterans Claims website, it was in a rare data format. So I converted
it to both plain Text and to MS Word format for you, without changing
the content. You can choose which version you like better for your
purposes:
