Can my husband still work somehow while awaiting his ajustment of
status. we recently got married, and the INS are behind on the
applications apparently. Thank you

My husband has been in USa for 3 years on a student visa and his work
permit expires june 28th 2004. The ins documents came back because on
my petion for alien relative (my Husband), i forgot to sign it DUH!!!!
So I called ins and they send sign and resend, and she said he should
stop work as of june 28th an await the filing process of his new wrok
permit!! Hello.. like we will go broke doing that, and we sent the
forms in 5 weeks ago, they just came back.. soo now we need to wait
again..im nervous. she did not say anything about how he can work
while awaiting our complete filing status.

Yes he can. But it depends on his status. Usually you can apply for an
Employment Authorization Document during the interim period until such
time the adjustment is complete. The INS will approve the EAD based on
the merit of the application. Form I-765 is the form used.

Im sorry.i failed to say he has a work permit that runs out june 28th.
Tha means he should not work until the new work permit is sent to us.
I assume they will get the work permit documents started before the
adjustment of status.
