I need to know who is responsible to remove a tree stump and replace a
tree that was fallen in a wind storm in oct. 2003? The tree was
planted by the developer of the subdivision in 1990 and was located in
the parkway along the street. The village has pruned and maintained
the tree over the years. The parkway is considered easment and public
property. I live in Island Lake IL. USA in a subdivision called
Westridge. (60042)

Hello Mdoyle3200,

According to the Villages of Island Lake Public Works website, the
public works department is on call 24 hours a day to handle trees
damaged by storms.

"The Village is graced with an abundant amount of trees throughout
town. These trees require periodic maintenance, in the form of
trimming, to provide for adequate visibility and clearance along our
36 miles of roadway. Not only do we trim the trees as needed, we also
are on 24 call should the weather damage them."

"If you have any queries regarding our work, service, or just want to
ask a simple question, please give me a call or an email. I can be
reached at 847-526-8767 or willie@villageofislandlake.com"

This information was found on the Village of Island Lake website.

So, it seems that would be who you would contact about your situation.

i have already contacted willy. willy says that there is no money in
the budget for my tree. he also said he cannot do it for me or he
will have to do it for everyone else. I want to know if there is a
law on the books somewhere that states who will be responsible to
replace my tree.

Hello again,

I spoke with the Village police department and they gave me this
information. The Public Works department is responsible for the tree
if it is on public property thet they maintain, or city property. If
the tree is on private property or property that belongs to the city,
but that you as a property owner are required to maintain, such as
shoveling or mowing, the tree is your responsibility.

If your not sure which category the area with the damaged tree falls
under, you can contact the building commissioner, who can give you
that information or help you further contact someone in your city with
access to property records. You can contact him during business hours
at 1-847-526-8764.

I hope this clears up the city laws regarding this matter and whom you
need to contact in your area.
