Can a Parent evict an adult son who is living at home, contributing nothing but lip and stress? He is 23 years old and living free in a house addition. The parent think (s)he will need a formal eviction notice and incur legal fees. Is this true? In my day, if you were a drain on the parents they had the right to kick you out as an adult. | |

An adult child living rent-free in the home of a parent at the graciousness of that parent, and having no verifiable claim to the property (ownership, rental agreement or other contract) is considered nothing more than a guest who resides there at the will and discretion of the homeowner (the parent). Based on that alone, you can merely ask him to leave as you would any guest whose conduct is disorderly and, if he refuses to do so, call the police and have them remove him. If you had to you could get a restraining order against him. Then if he comes back you would call and the sheriff would take him away. It is really a shame that it has gotten to this point but you aren't doing him any favors by having him live at home like that. At that age he should be in college fulltime making academic progress and have a part time job. I know that Orange County is expensive (I live in El Toro) but he can just go get 4 or 5 roomies and a job like others his age. That or stick him in the Army. It is time for him to stand on his own 2 feet or you will also be supporting his girlfriend and their kids. |

Well, a few things have changed, a. This is NOT my son, I have no kids at all...only dogs <G> and b. I have shown her this and other answers but he still sits there at home, moaning about having to do chores having to share a computer and such, They had no milk in the house but he went and bought his cigarettes..!! She, the mother, is not acting on anything. I'm writing this one off. I don't mind helping ppl, but after a time it gets old. It goes from help to 'Vampirism' Thank you for the answers, I'm near South Coast Plaza :-) I'll mark this as done and from now she can deal with her own garbage. |
