I have been assaulted at the gas station by Exxon employee. They were replacing a battery in my car. When I came to pick it up, we had a disagreement about the price. The quote they originally gave me was a third of what they were charging me. These 4 Exxon guys were pretty much yelling at me the whole time I was there and pointing fingers at my face. The highlight of the incident took place when one of them decided to replace my new battery with my original battery. So he decided to take it upon himself to get the keys from me regardless my consent. He tried to grab them, pull my arm, push me. After all unsuccessful (through all this time I was feeling like its not happening - this is a place of business!), he tried to intimidate me by standing 2 inches away from me and yelling at me and all this time trying to get the keys from me. My boyfriend got between us and was telling him to calm down. At that point I walked out and called the police. I filed a police report. What is my best course of action? Its not about the price that they charged me. Its about the laws that are protecting everyone from being assaulted especially in the place of business. He was completely outside the line and I want to take action. He needs to be responsible for his actions. Since he works for Exxon, I was expecting a certain level of customer service. Thank you! Well your best bet is to contact legal support. If the employee assulted you as you say. It would make you case stonger agaisnt him if you had a eye witness. I don't know of any links to obtain this free advice but if you call around in your area there may be a legal aid or something of the sort. If you don't want to choose this way you could contact the better buisness Bureau at http://www.bbb.org/ And report them for there misconduct. You may also contact the indaviduals suppior and talk to them and explain eveything. Words of advice though if you do decid to contact his employer, remain calm don't use a threatining voice, be as polite as possible. Becuse if the employer would be willing to help you come to a happy ending to this, well keeping a cool head would be the way. |

The gas station is likely franchised or the name is licensed and the guy does not work for Exxon Mobil Corporation. |

Obviously, see an attorney right away. I know you kept a copy of the police report, right? Your boyfriend is a witness, if you had any more, that would be great. The police enforce the laws against criminal assualt. If you feel that you have been harmed and are due monetary damages, then you should begin to build a civil case to prove the extent of your harm. If you have any physical injury, seek medical care right away, or if you have any bruises from being pushed, take pictures of them. Mostly it sounds like the harm is emotional. You may wish to see a counselor. These visits would help document your emotional harm. Of course, this is not legal advice, just my personal opinion. See an licensed atty asap. Best wishes. |
