NYC TRAFFIC LAW Can New York State traffic tickets for moving violations (yellow color, not to be confused with NYC parking tickets) be dismissed on the basis of illegible or inaccurate information as handwritten by the police officer? ie. human error - missing VIN digit, incorrect place of occurrence etc. If so, what constitutes a dismissal? Thanks in advance. |

I'm not an expert in NY law, but as a guideline, the usual standard is that the error or omission from the ticket must be significant and material. So, something like a missing digit from the VIN based on a human error probably would not be grounds for dismissing a ticket. However, saying that you were going 55 in a 35 mph zone when it actually was a 45 mph zone would likely be grounds for dismissal. |
