I own a condominium here in San Diego. Two months ago the entire
building (7 units) was owner occupied, but two months ago an owner
sold and the new owner rents out the unit. The unit, currently, is
being rented out to NINE guys, aged between 19-23.
While these 9 guys are definitely nice and respectful if you ask them
to keep it down, they have a hard time "keeping it down." It's
understandable with so many of them in once place. The noise issues
aren't obscene, but these guys have wacked hours, and are usually up
til 5:00 am on weekdays. It's been especially bad as of late, as I've
been woken up sometime between 2:00 and 5:00 about every other day for
the past few weeks due to a party they're having, or playing music too
loud, standing outside and talking too loud, etc. Plus they all ride
bikes, so there's like five bikes in their front little lawn area at
any given time, and they all smoke, so cigerette butts abound in their
outside area.
Now these guys are leaving in a little over a month, and I think I can
stay sane until then, but what I am wondering is whether or not it's
legal to rent out a 1,050 sq. ft. condo to 9 people. Is this breaking
some sort of firecode law? These aren't family memebers, either, just
nine friends. What I want to make sure it that this guy doesn't rent
out his place to a gaggle of tenants once they're lease expires.
Basically, I am looking for ordinances, laws, etc. that limit the
number of tenants a landlord can rent his unit to here in San Diego,
California. One option other owners and I have discussed is adding
something like this to the Home Owners Association's CC&Rs, but I
don't know if that is necessarily legal. (Just like we couldn't add a
bylaw that says, You can only rent to heterosexuals.)
Any help much appreciated. I want to be able to enjoy an entire week
without waking up in the middle of the night three or four times at
odd hours.
