Question ID: 385130
i hit a car from behind and it hit another car. I was over the limit
as was found out later at the surrey, bc jail. by blew 120. That car
then hit another car in front of it and i am worried what they can sue
me for. My car has been inpounded for 30 days and i have now a 3 mths
driving ban.
Also, i hit a car 2 hours prior to that and no breath was taken and i
was not drunk. the cop thought i was and he gave me a 24 hr
suspension. i drove anyways, and the three car accident happened.
i am being charged for driving while prohibited and intoxiated.
Please give me some advice until i see my lawyer on wednesday or so.
just to put things in perspective.

main concern is can the other partys sue me. they could not have been
hurt that much but, knowing my luck they will claim injury. I know i
will have to pay for my vehicle probably what what does the law and
icbc do in such situations.
I know that i should speak to a lawyer but i just need general help.
I dont mind them taking my licence away or giving me a reasonable fine
for whatever reasons they decide but tell what how bad it can get?

Hi again, tuta. In a nutshell...

"BC has the toughest laws in North America for DUI Impaired. You can
even be charged with a separate criminal offence of Refusing to blow
into the BAC Datamaster (breath machine). Although George couldn't
double dip his chips, the State double dips in DUI: you can be
penalized Civilly with licence prohibitions and fines, and also
criminally with real-jail; mandatory fines; probation; and
alcohol/drug evaluation and treatment. ICBC Point Premiums, etc."

It's only money, right? Speaking from US experience only, you won't
be sued for more than what they think they can get, usually the amount
of insurance coverage.

However, if you have other assets, you might also discuss asset
protection with your attorney when you meet with him or her.

If possible, after discussing it with your attorney, you might make an
offer to compensate the second driver who was hit by the car you hit.
However that person was harmed, make it right (in exchange for a
release of liability) - with money or sometimes just an apology will
work.

Good luck.
