Although George couldn't double dip his chips, the State double dips in DUI: you can be penalized Civilly with licence prohibitions and fines, and also criminally with real-jail; mandatory fines; probation; and alcohol/drug evaluation and treatment. It's only money, right? Speaking from US experience only, you won't be sued for more than what they think they can get, usually the amount of insurance coverage. However, if you have other assets, you might also discuss asset protection with your attorney when you meet with him or her. If possible, after discussing it with your attorney, you might make an offer to compensate the second driver who was hit by the car you hit. However that person was harmed, make it right (in exchange for a release of liability) - with money or sometimes just an apology will work. Good luck. |
