(1)can i file a lawsuit or any form of action, against a private
catholic pre-school, kindergarten for discrimination, treating my
child bad, for expelling my child the last day of school over the
telephone after he was told to be back for the fall without any prior
notification nor any notification that a problem exsisted. the
director told me that my child had a very short attention span so he
would be held back in kindergarten another year, the main reason given
was his "lack of skills" when i asked what specific skills i was told
that he has a very short attention span. I inquired as to whether it
was short like most kids his age or abnormally short, and was told
"abnormally short" so he could not move up in class. This caused me
great concern as i thought perhaps he had A.D.H.D as my 6 year old
daughter and I have it and my husband has A.D.D. That day the director
sent me a letter and did not mention the "attention span problem", it
was completely left out of the letter and the reaosn for holding my
son back changed to "his not being toilrt trained. I had just read the
list of names in the office of the potty trained children and my son's
name was clearly on it. I wrote back (the school stresses
communication, they want to be informed about anything going on
outside of school that might impact his behavior or participation at
school. I kept them informed of all my operations, my daughters two
operation, my father i.c.u stay and his prognosis, our travel plans
and my work schedule. It bothered me and caused me great concern that
the communication issue was not mutual. I was never informed that my
son had an attention problem nor did I ever receive notification of
any problems. Several teachers (mostly ones wh have left the center
b/c of problems with the new director) a teacher still teaching, many
teacher aides, that the director did not like my husband or me and she
went out of her way to may things difficult for him and to try and
make us quit the school. while she will never admit this, the new
director does not like us because some of the teacher's aides work for
us on the weekends and babysit. we are not the only family that has
used an aide as a babysitter. we did not violate one single rule of
the school and i ecieved a phone call after the sumer seeion ended
this past friday that my son was not welocmed back b/c of the letter I
wrote asking for answers and more details about his problem. "Can you
expell a child from school b/c the parent writes a very professional
letter addressing the issues that were in a letter sent to me by the
director. It was done in spite and to hurt my husband and me, the
director knows that the fall school year begins in one week and there
is no way we can find a school with openings this late. Can a private
school expell without just cause or prior warning? Do I have any
action or recourse? Who do I file a formal complaint with?

(4)how can i obtain a copy of a private schools handbook of rules,
ploicies and procedures. do you know if i can obtain a copy of the
Elisabetta Renzi child development center's handbook, on-line? they

Hello bluedog1967,

Let's get some of this clarified out, as this question seems to be
asking many different things.

You want to know if it's possible to file some sort of legal action
against a private catholic pre-school, Elisabetta Renzi Child
Development Center, in Shreveport Louisiana.

The basis of the lawsuit is discrimination against your child.

You feel they have discriminated and been untrue to you in why they
have not accepted your child back. You were given no prior warnings
before summer session ended that this action was imminent.

You have been given reasons for the expulsion as "abnormally short"
attention span, and not being toliet trained, (though you state you
saw his name on a school list saying he was toliet trained).

You feel this may be a personal matter coming out as a professional
matter due to personal conflict with the director.

Therefore you want to know....
Can a private school expell without just cause or prior warning? 

Do I have any action or recourse against this expulsion?

Who do I file a formal complaint with about this expulsion?

How can I find out why a director was fired or "let go" from her

policies and procedures? This school is the Elisabetta Renzi Child

I'm just trying to make sure we all as researchers can understand the

Laws not complex.

Generally people consult lawyers on legal issues.

Some legal advice from a lamen.

You may need to fill out some forms, you should be able to get these
from a courthouse for a fee 5 or 10$ seems regularly.

There are statute of limitations on cases so if you dont file you may
not be able to later on that is legal remedy should be done at the
earliest time posible.

You may need to proove there were some damages.

If you have ADD I suggest maybe getting a LARGE supply of ritalin if
your handling the legal issues yourself.

Other then this it seems sorta confusing. Especially holding a kid
back for kindergarten? because their attention span was too short.
odd. If you have records of all discusions letters and such they may
be useful as evidence.

Of course believing you know other peoples ambitions is questionable.
I suggest getting ahold of the previous teachers and getting
information and also doing a background search on the teacher. If you
can get proof that supports this you may be able to do so, however
what type of damages were done?

Honestly I dont see how it should be the director saying why a student
is held back it should be up to the teachers however I'm not certain
how this is done.

You could try home schooling?

but yes you can try to file a lawsuit on anything prooving it and the
result of bringing it to trial may have different results.

States can regulate private schools you may like to look at what
regulations may be implace.

for instance attendance for the one day is

Length of School Year/Day: To be classified as a school under the
General School Law provisions, the institution must operate a minimum
session of 180 days. La. Rev. Stat. Ann. § 17:236.
Did you child go to school for 180days

what was the reason for suspension? unless i misread it


I'd ask the administrator if testing for ADD and proper education can
remedy the situation, if you honestly are suffering personal damages
then its another issue.

The held back thing

Curriculum: State approval of a nonpublic school is dependent on
whether the school meets and maintains a sustained curriculum or
specialized course of study of quality at least equal to that
prescribed for similar public schools. La. Rev. Stat. Ann. § 17:11.

I suggest finding out if  :short attention span:  is allowable as a
reason for being held back...? generally school is grading isn't it?
whats next he limped funny..?

as for bowel potty training issues I suggest getting some photo
evidence of your child being potty trained ASAP. If you can show he is
potty trained there may be another issue.

IF the administrator is lying and such he shouldn't be in that
posistion and if you can shed light on it it may not only be good for
you and your child but also other indviduals.

if you have any specific questions feel open to ask them via email if
they arn't answered here(or restate them here) and i can research it a
little more)

however generally people contact legal counsel (lawyers) 
small claims is like 51$ or something like that admissions in the
state court is 150$ etc.. I'm not sure of all fees etc.. at this point

an individual can file a courtcase in lousiana I'm not certain if they
need to be in good standing though... or what good standing
requirements are.

Theres lots of info you may not need standing/barstatus for small
claims I"m not sure about an actual civil trial though.. you might
need to check on that.

So sure you can if you honestly beleive its pro socio pro bono publico
but it might cost you anywhere from 50 to well.. $$$$$$$$'s

Personally I have issues with the court system as well as lawyers(due
to the nature of nonnatural law0)

advice 

1. dont let it get to you it shows your weak character
2. just kill the administrator(just kidding)
3. public and special intrest education is wak but time with work and
all is understandable
4. if the school is messed up why keep him there
5. in some way the administrator is doing it for some good reason
whatever it may be(in their own twisted sense of ethics and social
interest)
6. Id discus it rationally or get a third party perhaps unbiased to
arbitrate it for you
7. if you go to court it could take some time... society is very
bigoted even more so with :LAW: you dont know he did it to hurt you if
you were hurt thats personal injury and he should know it so that it
doesn't happen in the future..

I could write allot more but since you have ADD and all.

note I'm not to my knowledge on bar in lousiana so I can't offer this
