I'm interested in knowing if the word "Stradivarius" is available to
be used as a trademark or product name in association with digital audio
recordings (namely CDs and CD-R's) related to testing, tuning and
'breaking in' audio equipment.

Comprehensive trademark searches are so expensive, and I can't afford
one (I'm currently on a fixed, low income and looking to start a very
small business and to name my product).  It's unlikely I'll ever be
registering the word as a trademark (if someone comes after me I'd be
extremely likely just to change the product name).  I've conducted a
free U.S. Federal search and it
looks like I'm in the clear, but if someone with access to the right
databases can help a financially poor guy like me with the state/local
stuff I'd greatly appreciate it.

P.S. I'm being totally honest about my income.  If I could afford a
comprehensive trademark search, I'd have one done.  The past few
months have been tough and I'm literally paying as much as I can right
now for an answer (or even just some tips/suggestions).  Thank you.

Keeping in mind that there are trademarks that might be "in the works," I
think you are OK on a federal trademark level.  On a local level, you just
need to check with the Secretary of State where you live, and that should
not have any cost (other than a phone call) associated with it.

Your biggest problem is that there is a CD (music) label by the same name
as the one you are seeking to use.

Although they are a small label and based in Italy, there could be some
confusion.  That might produce some ill will, something you want to avoid.

If it were me, I would work up another name.  You might want to try to come
up with a name that would make for a stronger (future) trademark, such as a
"made up" word, for your product.  Tunivarious?  Testivarious?

Thanks Denco, that's good advice.  The CD music label in Italy does
make me a bit nervous... will think about changing the name.
