My wife died recently and in her will she left the whole of her estate to me. This in reality comprises the house, with a substantial mortgage. She left two children, ages 16 & 14 who have been living with their father for the last 18 months. She had an income from a pension of £350 pcm and a number of benefits due to her illness. The childrens father has contacted solicitors who have demanded a copy of the will. And informed me in the opening letter that unless I offer "reasonable financial provision" for the children application will be made under the above act. As far as I can tell from my own research the dependants have a case where they were being supported by the deceased, or in the case of minors where it will further their education. My wife had not paid anything to support them since late last year after a disagreement provoked by their father. Any input on this would be appreciated. |
