Thanks for asking!
And thank you for a speedy reply to my request for clarification.
Your site is not banned -- the listing by name is proof that the site
is at the very least eligible for indexing. You're also seeing the
Googlebot -- another sign that the site is eligible. The Googlebot
ignores sites that have been banned.
Your site may be suffering with what is called the "Sandbox Effect" --
a phenomenon that characterizes new sites and their Google rankings.
SEO Round Table's "seoguy" theorized: "Some good friends of mine and I
have been tossing around the idea of the sandbox effect. Basically it
states that PR and back link (pure link popularity) credit is placed
in a reserve for a period of time say 2-4 months before it is applied
to ranking and has an effect. The theory behind this is to combat PR
purchasers from Google bombing, jumping into a field and dominating
right off the bat. If PR appears to not be working people will stop
buying it. If people stop buying page rank then its original purpose
gains validity again. But instead of having to dump it because of
abuse wait till people realize its no longer useful just put a delay
on its effect and people will ?think? it no longer counts and those
spending thousands abusing it will quickly realize after 1-2 months of
no benefit that it no longer works and move on."
Seach Engine Roundtable | The Sandbox Effect
http://www.seroundtable.com/archives/000368.html
The Sandbox Effect has been seen more frequently with sites brought
online after Google's Florida update in November, 2003. It is thought
to be applied only to sites that seem to grow (PR-wise and linking) at
an unusually fast pace. There's no way to test with certainty that a
site is sandboxed. Methods postulated early on have been shown to be
inconsistent. The Sandbox Effect is -only- a theory, a set of
observations that appear to explain why sites are taking two to six
months to establish initial PageRank.
--- OR ---
The website may simply be too new, and has not developed enough votes
(inbound links) to have achieved PageRank.
Whichever the case, the path to the best/highest listings possible is the same.
Current "Happenings"
----------------------------------------------------------------------
An update took place at the beginning of August, with an apparent
adjustment of the main ranking algorithm to even further
discount/penalize purchased PageRank. This update also seems to
devalue some normal organic linking to a variable degree.
Many sites created in early Spring are still without PageRank. Google
watchers are anticipating a PageRank update soon, however, there are
many sites in line ahead of yours. There's no prediction of which
sites might be released from the theoretical Sandbox.
As you mention, a deep crawl is underway. It seems likely that those
newly fetched pages will form the basis of future updates of both the
index and of PR.
Placement Improvement Strategies
---------------------------------------------------------------------
Over-optimization is penalized. Paid links are penalized. Duplicate
content is penalized.
Looking at your keyword density (homepage) it seems as if density is a
bit on the high side, at least for the moment. The current "best"
range is said to be five to seven percent.
5 california criminal attorneys 13.51%
5 criminal lawyers california 13.51%
5 lawyers california criminal 13.51%
4 san francisco criminal 10.81%
2 attorneys puri walia 5.41%
2 california state federal 5.41%
2 francisco bay area 5.41%
2 francisco criminal lawyers 5.41%
2 lawyers san francisco 5.41%
2 northern district california 5.41%
2 san francisco bay 5.41%
2 san francisco oakland 5.41%
2 santa clara san 5.41%

When using this tool, uncheck the boxes next to Meta Keywords and Meta
Description -- Google doesn't use these meta tags in content analysis.
A look at all your backlinks shows they're pretty thin.

You'll need to obtain links in order for your site to be recognized as
important enough to include among the most relevant in the category.
Possible sources:
ODP (Open Directory Project) http://www.dmoz.org
You'll want to link geographically. If you have -excellent- consumer
law information, articles, or other independent pages, you may submit
those pages separately in additional categories. Get your first link
in with a solid description, and be careful not to spam the ODP. Only
submit each page/site to a category once. Do not submit frivolously.
ODP is a human edited directory -- category editors have almost
zero-tolerance for over-submission. Many webmasters license portions
of the ODP for use on their own sites, which increases your link base.
You list the following organizations on your homepage:
Member: National Association of Criminal Defense Lawyers,
National Lawyers Guild, South Asian Bar Association, California
Public Defenders Association, Bar Association of San Francisco,
California Bar Association, American Bar Association - Bar of the
Federal District Court of the Northern District of California - Bar of
the Ninth Circuit Court of Appeals
Obtain links to your website from as many as possible. Martindale
Hubbard is another important inbound link.
Do-it-yourself optimization is a tricky proposition. Experiment -very-
sparingly. A misstep can cost you dearly. The best strategy for those
"outside the profession" is to create a site that is supremely helpful
to your clients and expected visitors. Ranking will follow.
Time/longevity is another ranking factor. Pages that focus on one
subject or set of keywords generally rank higher than pages that try
to cover many keywords. Organic (natural) links in and out are useful.
YOu're judged by the company you keep, at least as far as outbound
links go. Don't link your site to any questionable link schemes.
Once you've refined your site and added links you can use Google
Rankings to track your progress through the top 1000 sites in any
group of keywords.
