I'm not finding that a case has been filed. A February 2004 law
journal article ( http://home.law.uiuc.edu/~ribstein/Ribsteinclassactionlawyersaslawmakers.pdf
) implies that such a suit would be unsuccessful "because of due
process concerns for public access to the law". If a lawsuit had been
filed, this article would probably have mentioned it. Instead, it
only refers to Milberg Weiss's cease-and-desist letters.

A search for

"Milberg Weiss" "copyright infringement" complaints federal

doesn't turn up any relevant lawsuits, and a Google News search for

"Milberg Weiss" copyright

returned zero news stories -- if anything's happened in the last month
or so, I'd expect to see some news about it.
