Argentine living in Fl 2 yrs but not a US citizen wants divorce from
Brazilian who lives in Brazil.
Marriage took place in Argentina and they have not lived togethr for over 2 yrs.
Minor child lives w parent in Brazil argentine sends $ for the child each month
What is the process to pursue from Fl so Argentine can marry a US
citizen- and how long will it take?

Hi!!

I live in Argentina, so I will try to find for you some info related
to this subject. I do not know the US laws, but if I remember well
here (in Argentina) a marriage in a foreign country is not valid for
Argentina. My parents must "remarried" here to make their marriage
valid, this was several years ago, this could be changed.
You need to know if the marriage in Argentina is valid in US. I don't
think so due inmigration policies, but I am not sure.

I have been told by an attorney that he must get divorced from his 1st
marriage before we can marry in the US and that the requirements for
immigration are that the divorce be recognized by florida law. Since
the attorney in Argentina has disappeaed with the money we sent to
obtain the divorce in Argentina-We are now trying to pursue this from
Florida with a Fl attorney who knows about this sort of law involving
divorce when one party in not in the U.S.

A more broad comment...

 A ruling by a Judge in the US, even though having no bearing in a
foreign land, is a legal ruling in the US.  With that in mind, if you
could appear before a judge, and have that judge rule you un-married,
then your foreign marriage no longer exists inside the USA.

 For example;
 
 A US court can subpeona a foreign national living in a foreign
country.  If that person does not show, even though they are not in
the US, a bench warrant can still be issued for that person, and it be
served once they set foot in the US.
