Argentine living in Fl 2 yrs but not a US citizen wants divorce from Brazilian who lives in Brazil. Marriage took place in Argentina and they have not lived togethr for over 2 yrs. Minor child lives w parent in Brazil argentine sends $ for the child each month What is the process to pursue from Fl so Argentine can marry a US citizen- and how long will it take? | |

A more broad comment... A ruling by a Judge in the US, even though having no bearing in a foreign land, is a legal ruling in the US. With that in mind, if you could appear before a judge, and have that judge rule you un-married, then your foreign marriage no longer exists inside the USA. For example; A US court can subpeona a foreign national living in a foreign country. If that person does not show, even though they are not in the US, a bench warrant can still be issued for that person, and it be served once they set foot in the US. |
