I am getting a divorce and want to keep my home. Would I have my spouse sign a quit claim deed over to me and then I solely would hold the title?? If that were to take place could I then sell the house and keep any profits without being obligated to split them with my spouse? |

I would think that the matter that u are trying to address here would be controled by the laws in your state which can vary alot depending on where u live. It is also my understanding that even though you may have your spouse sign a quit claim he or she will still be on the mortgage making you BOTH responsible for the loan on the real estate, regardless of what the quit claim deed says. I could be wrong on this. The only way to solve your problem I would think is for you to have a lawyer draw up some papers laying out who gets the property and how it is to be split up. The only other way to get what you are asking that I can think of is to refinance the property in your name, that would legaly remove your spouse from the mortgage and give you what u are asking for.
