I have a Europeon photo drivers license. I live in New York....i do
not have a green card yet..My Europeon drivers license expires within
6 months. it is difficult or impossible to get a N.Y. driver\'s
license without a green card....is there any way or perhaps another
state that\'s easier to get a driver\'s license without a green
card??? thank you for your help.....tom

Hi, I ran into the same problem just about a year ago.  It is not the
points that are the issue, it is the "proof of date of birth".  As
there is nothing to satisfy the NYS requirement that it be good for
one year it may appear you are out of luck.  I went in on my 16th
birthday content on getting a permit.  They made me nearly cry when
they told me there is nothing they could do. The only thing that I
could suggest is what I did.  I went in multiple times and talked with
diffrent people there, and finally the supervisor on my fifth visit
decided that he would take my "Advance Parole" document(to let me
return to the US after going abroad) as a proof of date of birth. 
Basically there is nothing you can do but hope the guy in power is
nice.  They will also want the Social Security denial letter which can
be given to you on the spot at any Social Security office, just tell
them you need it for the DMV.  New York State DMV skirts around the
law which basically says they are only allowed to check for DOB and
Name Adress by asking for a DOB proof that is only good if you are
legal immigrant acorrding to their standards.  There are lots of
people (you and I included) that have no "proof" of status until it is
approved.  Good luck with the DMV and the INS.

So you're in the States ILLEGALLY but you're concerned about having a
LEGAL, valid driver's license?

If you are in the country illegally, you are not entitled to a
driver's license.  Please get yourself legalized, then worry about the
small stuff.

Tom here....i want it made clear that there are states that issue
drivers licenses to undocumented immigrants......that too is what i am
searching for...i hope this helps clarify everything......thank you

The problem here is a legal person who is waiting for a green card by
adjustment of status.  The process to get one takes about 2 years and
for the time waiting the person is allowed to live, work(with a
special permit), and travel outside(with a special permit) of the US. 
NYS has no way of giving a licence to a person in this situation even
though they are legal.
