1. Under Section 6 of application for a citizenship certificate from
outside of Canada ( proof of citizenship) under section 3 of Form
CIT0006(06-2001)E , which is available on www.cic.gc.ca
Under this section, there is a question which is being asked regarding
" other nationalities"
Are you a citizen of one or more countries other than Canada ?
If, yes, list the country or countries, date and how you obtained this
citizenship .
My nephew is presently a canadian citizen by virtue of the
naturalization of his parents in year 1995 . He was born in year 1987
and both of his parents and himself migrated to Canada legally in 1990
and his parents and himself were granted Canadaian citizhneship in
year 1995 . 8 years ago, all of them came back to the Philippines to
live.
My nephew is a natural born Filipino citizen because during his birth,
both his natural parents are Filipino citizens.
His canadian citizenship card was with the his picture when he was
still a little boy and it looks differently. He now wants to apply
for an updated one with his updated picture and signature.
Question : Will his Canadian Citizenship be affected or taken away
from him if he answers that he is still a Filipino citizen and has not
yet renouce his Filipino Citizenship ? This is with reference to the
Citizenship Act Chapter C-29 Part II- Loss of Citizenship 1974-75-76
, c. 108, s.7 Renunciation of Citizenship (. (1)A citizen may, on
application,renounce his citizenship if he
(a)is a citizen of a country other than Canada or, if his application
is accepted, will become a citizen of a country other than Canada. (e)
does not reside in Canada
In the past, I have heard that dual citizenship is allowed in Canada.
However, when my nephew consulted me regarding the application for
updating of Citizenship card, I want to make sure that I give him the
right advice.
Further explanation of my question, put in another format: Will the
act of declaring that he is also a Filipino Citizen, aside from being
a Canadian Citizen be an act of renunciation of Canadian Citizenship ?
Thereby affecting his Canadian Citizenship or make him loss his
Canadian Citizneship card and citizenship ?

Both his father and his mother are still Canadian Citizens and at the
same time naturalized Filipino Citizens . The parents became Filipino
Citizens sometime in 1976 to 1980 , before they migrated to Canada in
1990 .

Hi pnri,

"Will his Canadian Citizenship be affected or taken away from him if
he answers that he is still a Filipino citizen and has not yet renouce
his Filipino Citizenship ?"

Briefly, no, Canadians can be citizens of several countries without
suffering any consequences to their Canadian status.

Dual Citizenship
"Unlike the law in effect in Canada up to 1977, the present
Citizenship Act allows a Canadian citizen to acquire foreign
nationality without automatically losing Canadian citizenship. Since
February 15, 1977, a Canadian citizen may retain Canadian citizenship,
unless he or she voluntarily applies to renounce it and the
application is approved by a citizenship judge. The present Act thus
makes it possible to have two or more citizenships and allegiances at
the same time for an indefinite period."
http://www.cic.gc.ca/english/citizen/dualci_e.html

"Dual citizenship occurs when a person is the citizen of more than one
country. Canadian law permits this: you can remain or become a citizen
of another country and still be recognized as a Canadian."
http://www.voyage.gc.ca/main/pubs/dual_citizenship-en.asp

"Canada's Citizenship Act allows people to be citizens of two or more
countries at the same time. This also means a person should know the
rights and obligations required of them when they are in those
countries of citizenship. The law of the country where you are at the
time take priority over the laws of any other country where you hold
citizenship. International treaties, though, may override local laws."

>>> Updating your Citizenship Card

5. My citizenship card has my baby photo on it. How do I update my
photo on my citizenship card? Is it compulsory?
You can update your photo on your citizenship card by completing a
"Proof of Canadian Citizenship (CIT0006)". It is not compulsory by
law to update your photo. However an updated photo can avoid
unforeseen inconveniences."
