Dear jonnygorrill-ga

I have found the earlier Appeal Court judgement (2003) for this case.
I suspect the 2004 reference you have supplied, refers to the House of
Lords refusing leave to appeal (if it is not, then I cannot help you).

Would you accept a link to the 2003 Appeal Court?s 85 paragraph
judgement as an answer? It contains background facts, preliminary
issues, discussion of the Sale of Goods Act 1979 and the judgement.

For the price of your question I cannot provide any analysis.
