Dear malaka12-ga;
Thank you for allowing me an opportunity to answer your interesting
question. The answer is, ?possibly?. All damage related incidents like
the one you described, and damage resulting from other similar issues
such as potholes, manholes, barriers, etc., is reviewed by the New
York City Comptroller?s Office. If there is a decision to compensate
you for your damages the decision will originate from here.
There?s no way to know for certain how the office will respond to your
particular claim, but of course it can?t do any harm to make a claim
and find out:
You can download the "CLAIM AGAINST THE CITY OF NEW YORK AUTOMOBILE
PROPERTY DAMAGE" form and pertinent instructions here:
http://www.comptroller.nyc.gov/bureaus/bla/auto_damage_claim.pdf
SPECIAL NOTE: Your claim must be filed within 90 days of the accident
in order to qualify for potential reimbursement. If the claim is not
settled out of court, you must begin legal action within 1 year and 90
days following the accident or the city cannot be held liable.
Below you will find that I have carefully defined my search strategy
for you in the event that you need to search for more information. By
following the same type of searches that I did you may be able to
enhance the research I have provided even further. I hope you find
that my research exceeds your expectations. If you have any questions
about my research please post a clarification request prior to rating
the answer. Otherwise, I welcome your rating and your final comments
and I look forward to working with you again in the near future. Thank
you for bringing your question to us.
