I let somebody drive my automobile and he had an accident that was determened his fault. I am fully insured so my insurance company will pay the bill. Can I now sue the driver of my vehical for the full amount the insurance company has paid out and pay the insurance company so as to protect my safe driver discount. ( This in Canada) |

I'm assuming that this person is/was a friend or relative (if not then what were you thinking loaning them your car??) I always go by the rule: Never loan to a friend what you're not willing to lose. In this case you stood to lose your deductible + any additional premiums your insurance company charges you over the next few years (and of course any additional value your car had over the amount insurance valued it). So we're probably talking about a couple thousand dollars ... $500 deductible + $1000 increased premiums + $500 extra value you lost in your car. I suggest talking to your friend and showing him your own numbers of exactly what this accident will cost you and ask him to help you with that cost since you loaned him the car in good faith that he would return it intact. Asking him to pay you the full value of the car so that you can pay your insurance company won't put you in any better of a position financially than asking for the actual cost to you (the $2000+ amount) and would definately put further strain on any friendship the 2 of you have. Best of luck to you! Keep in mind that a friendship is worth far more than any car. |
