My husband got pulled over and was given a summons for court for
reckless driving, the cop said he was going 85 in a 55 hwy.  The cop
told my husband that he was going to pull over the car in front of my
husband since he was going faster but ended pulling my husband over
instead.  Our bigger concern is that my husband is on probation for  a
crimminal offense and we are concerned this is going to be be
considered a violation of probation.  My husband's court date is in
mid December so we have plenty of time. We are going to hire an
attorney and my husband also wants to take a driver improvement course
offered in our county(Fairfax) in hopes it will lessen the charge to a
traffic ticket instead of a RD.  I also want to mention that my
husband has a clean driving record and no other probation violations. Can you
give me any information as to how this will be handled more
importantly regarding the probation?

Just out of curiosity, did the alleged reckless driving occur in
Botetourt County, VA?  My husband received a ticket there for going
90+ on interstate 81.  Not true, but he had no way to disprove it. 
The traffic judge in that county is exceedingly strict and likes to
assign jail time for speeding on I-81.  I do recommend hiring an
attorney, esp. if the offense occurred in Botetourt.

No, it occured in Fairfax County.  Did your husband hire an attorney?

Yes, he found one that specialized in traffic law (among other
things).  The attorney arranged for a plea bargain in which my husband
would plead guilty and would be spared the jail time.  The rationale
was that because my husband has to pass federal background checks,
having jail time on his record would permanently damage his career.  I
guess the judge didn't want to issue a punishment that would have such
longterm effects.
