Hello! I am a non US Citizen or resident who had a sister that bought a property in the city of Cape Coral Florida. Unfortunately, my sister passed away 3 years ago and my brothers and I received her inheritance. However In her will there was no mention of this property, but we know of it because we have received bills and information about this place. We would like to know How can we claim this property? How much taxes do we need to pay ,if any? Who do we need to pay it to? We do know that there is an agreement between our Country ( Venezuela) and the USA that doesn't allow Venezuelan citizens to pay taxes on property inherited by an alien. Can you please answer these questions for me? Thank you E. Callahan |

The will must be probated in Florida, which is where the real estate is located. You need to engage a FLorida attorney to do this. If the will ahs already been probated in Venezuela, an exemplified copy can be porabted in Florida. There is a treaty between the US and Venezuela which will prevent double taxation, but if the value of the property exceeds the exemption, an estate tax will have to be paid. |
