I was arrested in Virginia for DWI.My drivers license is issued from
Michigan where I reside. I also refused a breath test.I understand
that if convicted of this I will lose my driving privileges in
Virginia for one year for failing to take the breath test. Will I also
lose my driving privileges in Michigan? Will the conviction of DWI
show up on my MIchigan DMV record?

Hi burden1,

Sorry to hear about your troubles in Virginia..

Althouth there was hope with the Driver's License Compact, the
Problem Driver Pointer System ensures that you will have to comply 
with the requirements in Virginia, or lose your Driver's License 
in Michigan.

It won't "show up" on your drivers record, Virginia will tell  
the PDPS (below), if you don't take care of the Virginia ticket, 
Michigan will take your license.

is stored. In conjunction with the Commercial Driver License 
Information System (CDLIS), PDPS is intended to assist jurisdictions 
in the meeting the basic tenet "...that each driver, nationwide, 
have only one driver license and one record," through the 
cooperative exchange of problem driver information between 
jurisdictions..."

Compact. An agreement between these states bascially says you have
only ONE drivers license record. Meaning, if you get a DUI in one
state it goes on your record (and stays) with whatever license you
hold..."


In your case, Virginia (VA) will report the DUI to the DLC, but Michigan 
(MI) is not a member, so they won't find out that way.

The bad news is that Virginia IS a member of the NRVC, and all 51 US
territories report to the PDPS who will tell MI about the ticket. 

Here's why I think they'll know, and your license will get suspended in MI
if you don't take care of the VA ticket:

Michigan has reciprocity with Canada which means they share information.  
If you pay, the conviction shows on your driving record.  If you do not pay, 
it will still show on your record as a conviction and you would risk having 
your license suspended.  The recommended course of action would be to 
handle the ticket and comply with any judgment..."


Reasoning is, if they share with Canada under some other reporting system,
they certainly share with Virginia in some way.


From the chart above:

NRVC/NO  (MI)
...means that if you are visiting MI carrying another state's
driver's license, VA will NOT notify the state you have a
license in that you have been pulled over and ticketed there.

So people with a valid Out-Of-State license that are visiting MI 
that are pulled over and ticketed while visiting, --MI will not
contact the state that the license is issued from The ticket stays in
MI and does not affect your driver's license elsewhere. They won't hunt
you down or contact your home state DMV  when you go home, except to
send you letters. You'll get FTA's and eventually end up with a
traffic warrant in MI if you ignore it completely.

NRVC/YES  (VA)
...means that if you are visiting VA carrying another state's
driver's license, VA WILL notify the home state that
you have been pulled over and ticketed in their state. This will
affect your driver's license in MI.

DLC/NO  (MI)
...These states do not access the DLC database when you apply for a
license in their state, and they don't send information to the DLC
database when you get a ticket.

DLC/YES  (VA)
..."This is a list of states that belong to the Driver License

only ONE drivers license record..."
