Hello!
I am an H-1B worker. My employer is currently sponsoring a permanent
residency application for me. The application is through Reduction in
Recruitment.
I am a Civil Engineer in Texas. After we passed the state level Labor
Certification, my application has been stuck in federal level Labor
Certification processing for almost a year and looks like it will not
be processed for another year because of the backlog.
My question is, if I accept a new job in Texas, or another state, and
transfer my H-1B to the new company, can I take advantage of the fact
that my current employer has already done the advertising and filed a
RIR Labor
Certification for me or will I need to start EVERYTHING from scratch?
Can I use anything from my current application? This is important
because I am on the 5th year of my H-1B. My understanding is even if I
get hired by a new employer, after 6 years, I need to leave US.
