I would like to know where to find the text of the privative clause(s) for the Ontario Municipal Board. There are over 180 pieces of legislation which give the OMB its statutory powers. The 3 primary ones, it seems to me, are: Statutory Powers Procedure Act, Ontario Municipal Board Act, & Planning Act, 1990. | |

Hello magtwinkle The OMB itself states that the three acts you mention are among the ten most important pieces of legislation relating to their work. It describes the statutes in the following list as the ten under which "most of the Board's work arises". See: http://www.omb.gov.on.ca/about/index.html You can find the text of these laws online: Ontario Municipal Board Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90o28_e.htm Planning Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90p13_e.htm Statutory Powers Procedures Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90s22_e.htm Municipal Act 1990 (soon to be superseded by the 2001 Act) http://192.75.156.68/DBLaws/Statutes/English/90m46_e.htm Municipal Act 2001 (not in force till next year) http://192.75.156.68/DBLaws/Statutes/English/01m25_e.htm Aggregate Resources Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90a08_e.htm Development Charges Act 1997 http://192.75.156.68/DBLaws/Statutes/English/97d27_e.htm Expropriations Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90e26_e.htm Consolidated Hearings Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90c29_e.htm Environmental Assessment Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90e18_e.htm Local Improvement Act 1990 http://192.75.156.68/DBLaws/Statutes/English/90l26_e.htm The Board agrees with you that, technically, another 90 public statutes and 80 private ones could be considered. You will find the text of many of these at: http://www.e-laws.gov.on.ca/tocStatutes_E.asp?lang=en I hope this is helpful but if anything needs clarifying, please let me know. search strategy: Ontario Municipal Board Canadian Law this led me to: http://jurist.law.utoronto.ca/locate.htm where I selected 'Ontario statutes' in the laws, statutes etc. box |
