I am completing a video documentary intended for TV broadcast that
will include the last 8 measures of Irving Berlin's "There's No
Business Like Show Business" performed by a local band at the
graveside of a circus owner in Oklahoma.  My concern is not with the
performers, but the rights to the piece itself.  Am I covered under
the notion of "fair usage"?

You can use it unless youre profiting from the film. Then you have to
get the OK from the copyright holder.
