I am looking for a printable source for the following two laws: That money put into a public charity can not be transfered into a private foundation that the donor controls That a person can not control a public chartiy by putting his own family members on the board of directors (these both sholud be easy to find in a treatise about non profits) |

I think the second of those actions is probably not prohibited. The first probably is, but under some circumstances may not be. However, any search for laws on the subject is going to differ by State. It is highly unlikely that anything you find in a treatise will be binding on anyone. |

In regards to the second part, this will depend on the specific charity. Public or not, it has rules that it has to abide by, including how the board of directors is appointed or voted for, and whether or not they may be related to each other, etc. One charity I know of recently fired a director, not because he was doing a bad job, but because he no longer fit the job description: his position required him to be employed by a publishing company, and he retired. As the other commentator pointed out, the first point is probably different from one state to the next. |
