In a condo association I was in charge of maintenance for several years. The condo association,of which I'm a part of decided they couldn't afford to pay me anymore. If sometime in the near future afterward the association hires somebody else to do what I did and pays them,do I have any legal recourse?Would me being disabled affect your answer? |

You would have to prove that your discharge was for other than the one they gave you and an illegal one at that. That is a pretty high standard to make. Since budgets are usually for a year at a time, if they hire someone in the year you were discharged without an increase in fees that might look suspect. However, if they hire someone in a subsequent year that is less suspect, especially if they raise the fee to help pay the salary. |

You can sue for anything, but it can be difficult to win. Can you prove they fired you because you were disabled - but still capable of doing the job? For piece of mind you should talk to a real lawyer - some will do a free consultation, or you might have to pay for an hour, but I strongly suspect that they will suggest that it would be to expesive to sue - with low expectations of a small payoff. Google answers does not give specific legal advice - if only to know your options, just talk to a real lawyer... |
